❖   How long do you have to file a personal injury claim? In medical malpractice claims the basic limitation period is 7 years from the date the cause of action arose, under section 5 of the Limitation Law, 5718-1958 (https://www.nevo.co.il/law_html/law00/71809.htm). If the damage is discovered later, the 7 years run from the date of discovery under section 8 — but a hard ceiling of 10 years from the event itself still applies. For minors the period only begins at age 18 (section 10). Each case must be checked on its specific facts; do not rely on a general rule without individual review.

What does personal injury compensation include? Past and future loss of earnings, pain and suffering, medical expenses, third-party assistance, mobility, and more. The amount varies according to degree of disability, age, profession and income prior to the accident.

Is the insurance company required to pay without a claim? Under the Road Accident Compensation Law, 5735-1975 (https://www.nevo.co.il/law_html/law00/4554.htm) there is no automatic first payment. A written demand must be sent to the insurer (or to "Karnit", if the vehicle is uninsured) under section 5. If 60 days have passed and nothing has been paid, the injured person may apply to the Magistrates Court for an "interim payment" under the Road Accident Compensation Regulations (Interim Payments), 5749-1989 (https://www.nevo.co.il/law_html/law00/98648.htm). The court will order an interim payment only if it is prima facie satisfied that the claimant is entitled to compensation, and not for more than two years from the date of the accident.

A case that began in 2021. The NII rejected the claim, arguing the injury was not work-related. The firm filed at the regional labor court; a court-appointed expert concluded that the injury was indeed work-related, and the file returned to the medical committee for its final determination.
